Texas THC Beverage Brand Delta Vine Faces Statewide Ban After Passage of SB3

Founders Have Until September 1 to Sell Out Before Their Legal, Low-Dose Product Is Forced Off Shelves

Austin, Texas — Delta Vine, a Texas-based company known for its non-alcoholic, wine-inspired THC beverages, is facing an abrupt shutdown after the passage of Senate Bill 3 (SB3) — legislation that effectively bans hemp-derived THC drinks across the state.

The new law gives companies like Delta Vine until September 1, 2025, to sell off their existing product before it becomes illegal to operate in Texas.

“We built this brand legally, responsibly, and with our own money,” says co-founder Morgan, a tech professional based in Austin. “We followed the rules. We third party test everything, and post the testing for full transparency on our website. We pay our taxes. And now we’re being erased by a law that came out of nowhere — without input from the very businesses it impacts most. I never thought Texas would be the one to kill our American dream.”

Delta Vine’s drinks contain just 2.5mg of hemp-derived Delta-9 THC and 5mg of CBD — a low, federally legal microdose intended to provide a relaxing alternative to alcohol. The brand launched in 2025 with a mission to serve “canna-curious” adults looking for a gentler way to unwind. Their beverages are non-carbonated, gluten-free, vegan, and only 80 calories per 12 oz can.

“We’re not making jungle juice,” adds Alex, Delta Vine’s other co-founder and a full-time firefighter. “This isn’t about getting people high. It’s about providing a safer, controlled alternative to alcohol — and now we’re being treated like criminals for it.”

🧾 SB3: A Modern-Day Prohibition?

The passage of SB3 has ignited debate across the state. Critics say the bill was pushed through with little transparency and risks decimating an entire sector of compliant, tax-paying small businesses — even as alcohol and tobacco remain readily available.

“It feels like a 21st century Prohibition,” Morgan says. “We’re being banned for making something safer, cleaner, and legal. If this can happen in Texas, it can happen anywhere.”

🛑 Countdown to Shutdown

As the September deadline looms, Delta Vine is launching a “Last Call, Texas” campaign to sell through their remaining inventory while raising awareness about what’s at stake for local businesses, consumers, and cannabis innovation in Texas.

The team is calling on supporters to stock up, share their story, and contact lawmakers to question the intent and consequences of SB3.

“This isn’t just about Delta Vine,” Alex says. “It’s about how we regulate progress — and whether Texas still has room for small, independent makers with big ideas.”

🍷 Why We Started Delta Vine:

In 2023, it became legal for First Responders to obtain a prescription for THC, which is exactly what Alex did. Morgan noticed the positive effects that Alex had from using his prescription THC gummies for sleep and relaxing and wanted to try something for herself. They both saw all the THC seltzers that were available in major liquor stores, but most THC seltzers were either too bubbly, too intense, or just not her vibe — she wanted something smoother, more refined, and wine-inspired.
